Privacy Policy – information clauses on the processing of personal data by RetencjaPL Sp. z o.o.

 

The Privacy Policy contains information required under provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (GDPR).

The Privacy Policy also defines the terms of use of websites and services available through them, maintained by RetencjaPL Sp. z o.o.: atlaspanda.pl, stormwater.com, day.waterfolder.com.

Information clauses concerning the processing of personal data are grouped as follows:

  1. General clause.
  2. Visiting and browsing websites.
  3. Shopping in the online store.
  4. Registration and participation in events.
  5. Newsletters and alerts.
  6. Online form – orders for services.
  7. Social media.
  8. Information about your rights.

 

I. GENERAL CLAUSE

Pursuant to Article 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the “GDPR”, the Administrator informs that:

The administrator of your personal data is RetencjaPL Sp. z o.o., with its headquarters at ul. Marynarki Polskiej 163, 80- 868 Gdańsk.

  1. Purpose and legal basis of data processing

Personal data is processed in connection with the implementation of sales procedures on the basis of Article 6 sec. 1 letter c of the GDPR and on the basis of applicable law, concluded agreements (Article 6 sec. 1 letter b) and on the basis of the consent granted, to the extent and purpose specified in the consent (Article 6 sec. 1 letter a).

  1. Recipients of data

In the course of handling your case, personal data may be transferred to other entities. Recipients of the data may be entities authorised to receive personal data on the basis of the relevant provisions of law and entities which process personal data on behalf of the Administrator on the basis of an agreement concluded with him for entrusting the processing of personal data. Recipients of your personal data may be:

  • public authorities and entities performing public tasks or acting on behalf of public authorities, to the extent and for purposes resulting from the provisions of generally applicable law;
  • other entities which process the personal data on the basis of relevant agreements signed with the Company.
  1. Information on the transfer of data to third countries

Personal data will not be transferred to third countries.

  1. Purpose and period of processing

The Administrator may process personal data of the Customers for the purposes of implementation of statutory tasks laid down by the provisions of applicable law. In other cases, personal data is processed only on the basis of the previously granted consent in the scope and purpose specified therein.

  1. Rights of persons whose data is processed

You have the right, in the scope of your personal data being processed, to:

  • access your personal data;
  • rectify your personal data, e.g. when they are outdated or incorrect;
  • delete your data;
  • limit the processing of your data;
  • transfer your data;
  • the processing of data is based on an agreement concluded with the data subject or on the basis of the consent expressed by that person;
  • the processing is carried out in an automated manner;
  • object to data processing;
  • if you become aware of unlawful processing of your personal data, you have the right to lodge a complaint with the supervisory body, which is the President of the Office for Personal Data Protection with its headquarters in Warsaw;
  • in a situation where the processing of personal data takes place on the basis of the consent of the data subject, your provision of personal data to the Administrator is voluntary. You have the right to withdraw your consent at any time. Any activities related to the processing of data carried out before the withdrawal will remain lawful, without prejudice to the lawfulness of the processing carried out on the basis of the consent before its withdrawal.

We also inform you that we do not process personal data in an automated manner and that the data is not profiled.

 

II. VISITING AND BROWSING WEBSITES

Data processed in connection with visiting websites:

  1. Data: IP addresses, cookies and similar data about user activity or devices.
  2. The data administrator is RetencjaPL Sp. z o.o. as the publisher of websites and the manager of IT systems used to maintain them and support other services provided by RetencjaPL Sp. z o.o.

  1. RetencjaPL Sp. z o.o. uses cookies, i.e. small text information stored on the User’s end device (e.g. computer, tablet or smartphone). Cookies can be read by the ICT system of the Operator or other entities.
  2. RetencjaPL Sp. z o.o. stores cookies on the User’s end device to gain access to the information contained therein for statistical and marketing purposes and to ensure the proper operation of the Website, in particular to maintain the session after logging in and recognise the User in the next session.
  3. RetencjaPL Sp. z o.o. uses its own cookies for the purposes of:  analyses, research and audience audit, and, in particular, the creation of anonymous statistics, which help to understand how Users use websites to allow for improving their structure and content.
  4. RetencjaPL Sp. z o.o  uses external cookies to:
    1. promote the Web Portal by means of the social network facebook.com (administrator of external cookies: Facebook Inc. based in the USA);
    2. collect general and anonymous static data through Microsoft Clarity analytical tools (external cookies administrator: Microsoft Co. based in the USA); c) collect general and anonymous static data through LinkedIn Insight Tag analytical tools (external cookies administrator: Microsoft Co. based in the USA);
    3.  collect general and anonymous static data via Google Analytics and Google Signals (external cookies administrator: Google Inc. based in the USA);
    4. collect general and anonymous static data through Matomo Analytics (external cookies administrator: Matomo Inc. based in the USA);
    5. present advertisements tailored to the User’s preferences using the Google AdSense web advertising tool (external cookie administrator: Google Inc. based in the USA).
  1. The cookies mechanism is safe for the computers of the Users of the Web Portal. In particular, it is not possible for viruses or other unwanted software or malware to enter the Customers’ computers. However, the Users may limit or disable the access of cookies to computers in their browsers. If you use this option, the use of the Web Portal will be possible, except for functions which, by their nature, require the use of cookies.
  2. Below, we present how you can change the settings of popular web browsers in terms of using cookies. The User makes changes itself only from its device. a) Internet Explorer browser; b) Microsoft Edge browser; c) Mozilla Firefox browser; d) Chrome browser; e) Safari browser; f) Opera browser.
  3. The User acknowledges that cookies may be deleted by the User after they are saved by RetencjaPL Sp. z o.o. through: appropriate functions of the web browser, programs used for this purpose or using appropriate tools available within the User’s operating system.
  4. The User acknowledges that changing the configuration of the web browser to prevent or limit the storage of cookies on the User’s end device may result in limitations of the functionality of the Services. The deletion of cookies during the provision of the Service may lead to similar effects. The result of this may be the inability to log in onto the Website or interruption of the session after logging in.
  5. The Web Portal contains links and references to other websites. RetencjaPL Sp. z o.o  is not responsible for the privacy policies which apply to them.
  6. The User can manage cookies on the website by clicking on the button “Cookies Settings” in the footer of the page.

 

III. DATA PROCESSED IN CONNECTION WITH PURCHASES IN THE ONLINE STORE

    1. Data: name and surname, company name /VAT ID/, landline, mobile phone, city, postal code, state, street, country, login details (email and password).
    2. The data administrator is: RetencjaPL Sp. z o.o. as the publisher of websites and the manager of IT systems used to maintain them and support other services provided by the Company.

    3. We process data for the purposes of:
      1. ensuring a convenient use of the websites and services available through them;
      2. verification of the identity of the user for the purposes of monitoring abuse or verification of the rights to receive certain content or services;
      3. handling complaints and securing claims.
    1. The basis for data processing is the necessity to achieve the above mentioned purposes, which result from the legitimate interests of the administrator or third parties.
      For certain services, data or types of processing, you are asked to confirm your consent separately. In such cases, the basis for data processing is the consent of the data subject.
    2. Legitimate interests consist in continuously improving the quality, accessibility and number of visitors on websites or using services available through our websites, including the use free of charge, increasing the attractiveness of advertising space for both advertisers and ad recipients and providing users with a single online platform giving access to multiple services.
    3. The Administrator may provide data to other recipients only at the request of entities authorised to do so by law or when it is necessary to achieve the above mentioned purposes, e.g. to entities providing hosting, IT service, sales or support for the sale of advertising space on our websites.
    4. The administrator stores the data only for the time necessary to achieve the above mentioned purposes, but no longer than until the objection has been made in relation to the processing.

 

IV. DATA PROCESSED IN CONNECTION WITH REGISTRATION OR PARTICIPATION IN EVENTS

  1. Data: name and surname, email address, name of company/institution/organisation/editorial office/university, position/student, country, postal code, city, state, landline, mobile phone, login details (email address and password). For some services, the data may also include a photography.
  2. The data administrator is: RetencjaPL Sp. z o.o. as the publisher of websites and the manager of IT systems used to maintain them and support other services provided by the Company.

  3. We process data for the purposes of:
    1. registration for the event and creation of an individual account in the registration system, which will allow a change of the participant’s data and access to other services provided by RetencjaPL z o.o.
    2. identity verification when entering the facilities where the event takes place as well as printing and issuing the appropriate ID card;
    3. provision of accommodation and its settlement;
    4. marketing services and communication by RetencjaPL z o.o. with the participant, in the form of written or electronic correspondence or with the use of telecommunications equipment (telephones, SMS);
    5. statistics, quality and effectiveness measurements;
    6. handling complaints and securing claims.
  1. The basis for data processing is the necessity to achieve the above mentioned purposes, which result from the legitimate interests of the administrator or third parties, and the necessity to perform the agreement or to take actions at the request of the user before the conclusion thereof.
  2. Legitimate interests consist in constantly improving the quality, increasing the availability of events and the number of participants of an event, information about the services of RetencjaPL z o.o. or its partners and sponsors and increasing the attractiveness of advertising space for both advertisers and ad recipients.
  3. The Administrator may make data available to other recipients only at the request of entities authorised to do so by law or when it is necessary to achieve the above mentioned purposes, e.g. to organisers, partners and sponsors of an event; the lists of such recipients will be published and updated on the relevant pages of the event or in information materials. The recipients of the data may be entities authorized to receive personal data under relevant legal provisions and entities processing personal data on behalf of the Administrator, based on a data processing agreement concluded with them.
  4. The administrator stores data only for the time necessary to achieve the above mentioned purposes, but no longer than until the objection has been made in relation to the processing.

 

V. DATA PROCESSED IN CONNECTION WITH THE ORDER OF NEWSLETTER AND/OR ALERTS

    1. Data: in connection with the newsletter order, only the email address can be processed (if the user does not provide other data).
    2. The data administrator is: RetencjaPL Sp. z o.o. as the publisher of websites and the manager of IT systems used to maintain them and support other services provided by the Company.

    3. We process data for the purposes of:
      1. sending the ordered newsletter;
      2. marketing services and communication by RetencjaPL z o.o.  with users of the newsletter;
      3. matching content and advertising to the interests of users;
      4. statistics, quality and effectiveness measurements;
      5. handling complaints and securing claims.
  1. The basis for data processing is the necessity to perform the agreement or to take action at the request of the user before its conclusion (purpose mentioned in letter c subsec. i and v) and to achieve the above mentioned purposes, which result from the legitimate interests of the administrator or third parties.
  2. Legitimate interests consist in constantly improving the quality, availability and attractiveness of newsletters and other information services of RetencjaPL Sp. z o.o. by increasing the number of newsletters ordered.
  3. The administrator may provide data to other recipients only at the request of entities authorised to do so by law or when it is necessary to achieve the above mentioned purposes, e.g. to entities providing hosting, IT service, sales or support for the sale of advertising space on our websites.
  4. The administrator stores data only for the time necessary to achieve the above mentioned purposes, but no longer than until the objection has been made in relation to the processing.

 

VI. DATA PROCESSED IN CONNECTION WITH THE IMPLEMENTATION OF THE AGREEMENT VIA THE CONTACT FORM ON THE WEBSITES OF RETENCJAPL SP. Z. O. O.

    1. Data: name, surname, email address, telephone number or other data voluntarily entered into the Contact Form,
    2. The data administrator is RetencjaPL Sp. z o.o. as the publisher of websites and the manager of IT systems used to maintain them and support other services provided by RetencjaPL Sp. z o.o.

    3. We process data for the purposes of:
      1. enabling contact with the Company for reasons indicated by the addressee: request for quotation, service, etc.;
      2. enabling the performance of the service, sending the offer, etc.;
      3. monitoring of fraud;
      4. informing about the content and services of RetencjaPL z o.o.;
      5. statistics, quality and effectiveness measurements;
      6. handling complaints and securing claims.
  1. The basis for data processing is the necessity to achieve the above mentioned purposes, which result from the legitimate interests of the administrator or third parties.
  2. Legitimate interests consist in constantly improving the quality as well as increasing the availability and number of people visiting websites or using services available through them.
  3. The Administrator may provide data to other recipients only at the request of entities authorised to do so by law or when it is necessary to achieve the above mentioned purposes, e.g. to entities providing hosting, IT service, sales or support for the sale of advertising space on our websites.
  4. The administrator stores data only for the time necessary to achieve the above mentioned purposes, but no longer than until the objection has been made in relation to the processing.

 

VII. SOCIAL MEDIA

The administrator processes personal data of people who liked our social profiles developed on popular social networking sites. The data is processed in order to enable the running and ongoing management of our profiles, including in order to communicate with the community and to organise events or competitions on the terms specified by the functionality of individual social media and their Terms and Conditions. The data of community members is also processed for statistical and analytical purposes and may be processed in order to assert claims and defend against them. The legal basis for the processing of your personal data is the legitimate interest of the Administrator (Article 6 sec. 1 letter f of the GDPR).

 

VIII. INFORMATION ABOUT THE USER’S RIGHTS

In relation to the processing of personal data, the user (data subject) has the following rights:

  1. the right to request access to data;
  2. the right to request rectification of data;
  3. the right to request deletion of data;
  4. the right to transfer data;
  5. the right to request access to data;
  6. the right not to be subject to automated decision making, including profiling;
  7. the right to object to the processing of personal data;
  8. the right to lodge a complaint regarding the processing of personal data with the competent supervisory authority.
